1. Agreement to Terms

By accessing or using FitCal (the "Service"), operated by SLICED PAN SOLUTIONS LIMITED ("we", "us", or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Service.

2. Description of Service

FitCal is a fitness management platform that enables:

• Fitness professionals to manage bookings, payments, and schedules
• Customers to book fitness classes and sessions
• Payment processing through Stripe Connect
• Automated transactional email communications

3. User Accounts

3.1 Business Accounts

• You must provide accurate, complete, and current information
• You are responsible for maintaining account security
• You must notify us immediately of any unauthorized access
• One account per fitness business

3.2 Customer Bookings

• Customers do not require accounts to make bookings
• Bookings are made via secure links or QR codes
• Customer information is collected only as necessary for bookings

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purposes
• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code or interfere with the Service
• Attempt to gain unauthorized access to any systems
• Use the Service to send spam or unauthorized communications
• Misrepresent your identity or affiliation

5. Fees and Payment

5.1 Subscription Fees

• FitCal costs €39 per month
• 14-day free trial available
• No setup fees or hidden charges
• Billing is handled through Stripe

5.2 Transaction Processing

• We do not charge transaction fees
• Stripe fees are passed to customers or businesses per their agreement
• Payments go directly to businesses via Stripe Connect
• We never hold customer funds

5.3 Refunds and Cancellations

• Cancel your subscription anytime
• No refunds for partial months
• Booking refunds are handled between businesses and customers

6. Intellectual Property

The Service and its original content, features, and functionality are owned by SLICED PAN SOLUTIONS LIMITED and are protected by international copyright, trademark, and other intellectual property laws.

7. User Content

• You retain ownership of content you upload
• You grant us a license to use your content to provide the Service
• You are responsible for your content's legality and accuracy
• We may remove content that violates these terms

8. Privacy and Data Protection

Your use of our Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Service and informs users of our data collection practices.

9. Third-Party Services

FitCal integrates with third-party services including:

• Stripe: Payment processing (subject to Stripe's terms)
• Clerk: Authentication services
• Sendune/AWS SES: Transactional email delivery

Your use of these services is subject to their respective terms and policies.

10. Disclaimers

• The Service is provided "as is" without warranties of any kind
• We do not guarantee uninterrupted or error-free service
• We are not responsible for booking disputes between businesses and customers
• We do not endorse any fitness businesses using our platform

11. Limitation of Liability

To the maximum extent permitted by law, SLICED PAN SOLUTIONS LIMITED shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising from your use of the Service.

12. Indemnification

You agree to indemnify and hold harmless SLICED PAN SOLUTIONS LIMITED from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for:

• Breach of these Terms
• Non-payment of fees
• Illegal or harmful activities
• At our sole discretion

14. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through good faith negotiations. If resolution cannot be reached, disputes shall be submitted to the courts of Ireland.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms constitute the entire agreement between you and SLICED PAN SOLUTIONS LIMITED regarding the use of the Service.
